1 The Service

KWYH provides collection tracking mobile applications ("the App") that allow users to catalogue, photograph, and organise their personal collections. Current variants include KWYH Fabric and others as released.

The App is available for iOS and Android devices. Features and limits are described in Section 3.

2 Accounts

2.1 Registration

You must create an account to use the App. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.

2.2 Account Requirements

• You must be at least 14 years of age to create an account
• One person may not maintain more than one account per App variant
• You may not share your account with others, except where multi-user access is explicitly offered under a future Business tier

3 Subscriptions, Free Trial, and Payment

3.1 Subscription

The App offers a single paid subscription:

Prices are displayed in Canadian dollars (CAD) and may be shown in your local currency at current exchange rates. All subscriptions are processed through the Apple App Store or Google Play and are subject to their respective payment terms.

3.2 Free Trial

New users receive a 7-day free trial. The trial includes all subscription features, with reduced limits on items, photos, vendors, and AI credits. Billing information is required before the trial begins. You will not be charged until the trial period ends. To avoid being charged at the end of the trial, you must cancel your subscription through your App Store or Google Play settings, as described in Section 3.3.

3.3 Automatic Renewal

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• You can manage and cancel subscriptions in your App Store or Google Play account settings
• We do not process refunds directly — refund requests must be submitted to Apple or Google

3.4 Price Changes

We may change subscription prices at any time. We will provide reasonable notice of price changes through the App or by email. Continued use of the App after a price change takes effect constitutes acceptance of the new price.

3.5 Advertising and Deals & Sales Screen

During the 7-day free trial, the App displays a single advertisement on the loading screen. Paid subscribers do not see loading-screen advertisements.

All users have access to a Deals & Sales screen that displays hobby-relevant promotions from third parties. The Deals & Sales screen is voluntary — it is shown only when the user actively selects it from the bottom navigation bar. Paid subscribers may disable the screen entirely through the App Settings, in which case it will no longer appear in the navigation.

4 User Content

4.1 Your Content

You retain ownership of all content you upload to the App, including photos, item descriptions, and notes ("User Content"). By uploading User Content, you grant us a limited, non-exclusive licence to store, process, and display your content solely for the purpose of providing the App to you.

4.2 Prohibited Content

You agree not to upload content that:

• Infringes any third-party intellectual property rights
• Contains illegal material of any kind
• Is defamatory, harassing, or abusive
• Contains malware, viruses, or harmful code

4.3 Content Responsibility

You are solely responsible for your User Content. We do not monitor or review User Content and are not responsible for any content you upload.

5 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Attempt to gain unauthorized access to any part of the App or its infrastructure
• Reverse engineer, decompile, or disassemble the App
• Use the App to collect or harvest data about other users
• Use automated tools or bots to access the App
• Interfere with or disrupt the App or servers connected to it
• Violate any applicable local, national, or international law or regulation

6 Intellectual Property

The App, including its design, code, graphics, and all content created by us, is owned by KWYH and protected by Canadian and international intellectual property law. You may not copy, reproduce, distribute, or create derivative works from our content without our express written permission.

The KWYH name and logo are trademarks of KWYH. You may not use our trademarks without our prior written consent.

7 Disclaimers and Limitation of Liability

7.3 Data Loss

While we implement reasonable measures to protect your data, we are not responsible for any loss of User Content due to technical failures, third-party service outages, or events outside our reasonable control. We strongly recommend maintaining personal backups of important collection data.

8 Termination

8.1 By You

You may stop using the App and delete your account at any time through the App Settings. Deleting your account will permanently remove your data as described in our Privacy Policy.

8.2 By Us

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, or use the App in a way that harms other users or our business. We will provide notice where reasonably possible.

8.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Prepaid subscription fees are non-refundable except where required by applicable law. Consumers in Quebec and other jurisdictions with consumer-protection statutes may have additional rights regarding refunds and contract cancellation that override this provision. Sections 4, 6, 7, and 9 of these Terms survive termination.

9 Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the courts of Ontario, Canada, which shall have exclusive jurisdiction.

10 Changes to These Terms

We may update these Terms at any time. When we make material changes, we will notify you through the App or by email at least 14 days before the changes take effect. Your continued use of the App after changes take effect constitutes your acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the App and delete your account before the changes take effect.

11 Miscellaneous

• These Terms constitute the entire agreement between you and KWYH regarding your use of the App
• If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force
• Our failure to enforce any right or provision does not constitute a waiver of that right or provision
• You may not assign your rights under these Terms without our prior written consent
